Copropriétaires, vous vous questionnez sur l’éventuelle obligation de présenter votre pass sanitaire pour assister à votre assemblée générale de copropriété ?
La réponse est simple : Non !
En effet, interrogé sur la question, le ministère du logement a pu préciser que le pass sanitaire s’applique aux établissements recevant du public « uniquement pour les activités culturelles, sportives, ludique ou festives (…) et en aucun cas pour la tenue des AG de copropriété ».
Par voie de conséquence, la présentation du pass sanitaire ne peut être requise en matière de copropriété.
Le fait d’exiger ce document dans une situation non prévue par la loi constitue un délit puni d’un an d’emprisonnement et de 45.000 € d’amende.
Bien sûr, lorsque cela est possible, n’hésitez pas à envisager la possibilité de tenir votre assemblée générale via visioconférence
