En effet, vous ne pouvez pas librement vous rétracter si les trois conditions suivantes sont réunies :
A défaut d’accord amiable entre les parties, le juge appréciera les échanges entre elles afin de déterminer si un contrat est réellement scellé ou non.
Si le juge considère que l’offre acceptée ne satisfait pas aux trois conditions sus énoncées, il pourrait qualifier les échanges de simple entrée en négociation ne pouvant engager définitivement les parties.
Si, au contraire, le juge considère que l’offre d’achat acceptée remplit les conditions sus énoncées, elle serait alors qualifiée de contrat. Dès lors, le rétractant pourrait être condamné à verser à l’autre des dommages et intérêts et /ou condamné à une vente forcée.
